Encroachment Permit Application

Encroachment permits are required for any work performed within the public right-of-way in the Town of Atherton. This includes driveway work, utility installations, tree work, traffic control, staging, and any activities that may affect public streets or pathways.

How To Submit

Completed applications must be emailed to Helen Luo at hluo@athertonca.gov. Additional documents such as site plans, insurance certificates, and traffic control plans may be required depending on the nature of the work.

Types of Encroachment Permits

  • Right-of-Way Landscaping – Installation or modification of landscaping, irrigation, or ground cover within the public right‑of‑way.
  • Driveway – Connection to Street – Construction, modification, or replacement of driveway approaches that connect private property to a public street.
  • Utility Connect/Disconnect – Installation or removal of individual utility service connections such as water, sewer, gas, or electric.
  • Utility Main – Work involving new or existing utility mains, including repairs, extensions, or replacements within the public right‑of‑way.
  • Telecommunication Installation – Installation of telecom infrastructure such as conduits, fiber, or equipment within the right‑of‑way.
  • Telecommunication Wireless Antenna – Installation or modification of wireless antenna equipment or small‑cell facilities.
  • Tree Work or Removal – Pruning, root work, or removal of trees located in or impacting the public right‑of‑way.

Encroachment Permit Fees 

Working in the right-of-way without a permit may result in additional penalty fees.

Encroachment permit fees are not flat. Fees vary based on the scope and complexity of the proposed work. Final fees will be determined after the application has been reviewed and approved by Public Works.

Permit Processing Timeline

Encroachment permits are generally processed within 5–10 business days. Complex projects may require additional review time. Applicants will be notified if supplemental information is needed.
